Blowing 3.0DT Exhaust - design fault?

The exhuast note on my 2002 3.0 SWB Auto has been getting louder over the last few weeks, and removing the heatshield/underbody protector just behind the engine revealed that the exhuast has a really tight U bend around the propshaft, and both sides of the bend have long cracks in.

Has anybody else had this problem, and is it a warranty job? Am taking it back to the dealers for a check, but would be interested to know if it is a common failure. I have done some off-roading, so I'm a bit worried that the dealer will say it's my fault.

It looks like this piece of pipe also has the CAT in it, so could be mega bucks to replace! Crying or Very sad

my exhuast broke off at the flange that bolts to the turbo took it of had it rewelded might get another 30 thuosand out of it .Dont replace repair its cheaper Wink .The cat is used to a bit o heat ! but dont use exhaust sealing pastes on any flanges that are be fore the cat as it kills them apparantly its the biggest cause of cat faillure.
